A Brief Analysis of the Supreme People’s Court of the People’s Republic of China (SPC) Opinions  on the Adjudication of Artificial Intelligence-Related Disputes in Accordance with the Law

By Dongshu Zhou

On 7 September 2026, the Supreme People’s Court of the People’s Republic of China (SPC) issued the Opinions on Adjudicating Disputes Involving Artificial Intelligence in Accordance with Law. Comprising 24 provisions, the Opinions represent the SPC’s first dedicated adjudication guidance on AI-related disputes. In the absence of a standalone AI law in China, the Opinions clarify how existing legal frameworks, including the Civil Code, Copyright Law, Patent Law, Anti-Unfair Competition Law, and Personal Information Protection Law, apply to disputes involving artificial intelligence.
